Pharmacy Bill HR 152 Passed This Session

Effective July 1, 2005

Limits the sale of products containing ephedrine and pseudoephedrine.

 1.       All sole active ingredient products:

(a)  ephedrine, or

(b)  pseudoephedrine

must be kept behind the counter or in a locked case.

2.       When purchasing this product a person must:

(a)  sign a log,

(b)  show a photo ID or two forms of government-issued ID, and

(c)  be 18 years of age. 

3.       Over the counter sales are limited:

            (a)  two purchases, or

(b)  six (6) grams.

4.       Combination products must be:

(a)  kept behind the counter, or

(b)  in a locked case, or

(c)  under video surveillance with 30 day retention.

5.       Liquids and gel-caps are exempt from these controls.

6.       Wholesalers, manufacturers and re-packagers not licensed by the Alabama State Board of Pharmacy must register with the ABC Board.

Effective October 1, 2005:

1.  Wholesaler, manufacturer or repackager (not licensed by BOP) must register with ABC Board

2.  Retailer (not licensed by BOP) must register with ABC Board

3.  Sales of ephedrine and pseudoephedrine by wholesaler, manufacturer, repackager or retailer without a license is a Class A misdemeanor.

4.  Licensed wholesalers, manufacturers, repackagers or retailers that make unlawful sales shall have registration cancelled for at least one year or possibly longer.
